- Session 1
How Mediation Actually Works
This session provides a detailed explanation of the mediation process from initial consultation through final agreement. Participants are introduced to the structural components that govern mediation, including voluntary participation, confidentiality standards, neutrality, and procedural sequencing.
The mediator will explain how issues are identified, how information is exchanged, and how negotiation sessions are typically structured. The distinction between facilitative mediation and evaluative approaches will be clarified, along with the mediator’s role in managing communication without imposing decisions.
Participants will also review mediation readiness indicators, including the ability to disclose financial information fully, engage in constructive dialogue, and participate in compromise. Situations where mediation may not be appropriate—such as significant power imbalances or safety concerns—will be addressed in general educational terms.
The session concludes with a step-by-step timeline illustrating how mediated agreements are drafted, reviewed, and formalized into legally binding documents.
