The Legal Framework You Must Understand

This session establishes the legal structure within which mediation operates. While mediation allows flexibility in resolution, all agreements must comply with governing legal standards.

Participants will receive a clear overview of property division principles, including the distinction between marital and separate property and the implications of jurisdictional rules (such as community property or equitable distribution frameworks). The attorney will explain how debts are treated, how disclosure requirements function, and why transparency is essential for enforceable agreements.

The session will also cover custody standards, including the legal distinction between physical and legal custody, and the general principles courts use when evaluating the best interest of the child. Child support and spousal support frameworks will be introduced at a structural level, emphasizing statutory guidelines and relevant factors.
